1. Acceptance of Terms

By downloading, installing, or using Fulik, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the app.

2. Description of the Service

Fulik is a plant care app that allows you to:

Identify plants from photos
Analyze possible plant health issues
Receive care guidance for watering, light, humidity, and general maintenance
Save plants to a personal garden and mark favorites
Track plant care information
Access premium features through an optional paid subscription (Fulik Pro)

Features may vary between the free plan and the premium subscription.

3. AI-Generated Guidance Disclaimer

Fulik uses AI technology to provide plant identification and care suggestions. These suggestions are for informational purposes only.

Important:

AI results may be inaccurate, incomplete, or unsuitable for your specific plant or environment.
You should verify important care decisions independently.
Fulik is not responsible for plant damage, loss, pest spread, disease progression, or failed treatment decisions based solely on app suggestions.
The app does not provide professional agricultural, botanical, chemical, pest-control, medical, veterinary, or safety advice.

4. User Responsibilities

By using Fulik, you agree to:

Provide accurate information when possible
Upload only plant-related images that you have the right to use
Not upload illegal, harmful, private, sensitive, or unrelated content
Not misuse the app, reverse engineer it, disrupt services, or attempt unauthorized access

5. Accounts

You may need an account to save plants, sync garden data, or access premium features. You are responsible for maintaining the security of your account credentials.

We may suspend or terminate accounts that violate these Terms or are used for misuse or abuse of the service.

6. Photos and Content

You retain ownership of the photos and content you upload to Fulik. By uploading content, you grant us a limited license to process it solely to provide and improve the service.

We do not claim broad ownership over your content.

7. Subscriptions and Payments

Fulik offers an optional premium subscription called Fulik Pro, which may include features such as unlimited scans, advanced diagnosis, smart care plans, and reminders.

Payments are processed through the Apple App Store using your Apple ID.
Subscriptions automatically renew unless canceled before the end of the current billing period.
You can manage or cancel your subscription in your Apple ID settings.
Refunds are handled by Apple according to Apple's refund policies.
Subscription prices and features may change over time.

8. Free Trials and Promotional Offers

Free trials or promotional offers may be available from time to time. After a trial period ends, the subscription renews automatically unless canceled before the trial expires. Offer availability and terms may change.

9. Acceptable Use

You agree not to:

Use the app for any illegal or unauthorized purpose
Upload abusive, offensive, or non-plant-related content
Attempt to bypass paywalls, subscription limits, or security measures
Use automated tools to scrape, crawl, or extract data from the app
Interfere with or disrupt the app's operation or security
Upload sensitive personal content such as images of people, documents, or private information

10. Intellectual Property

The app's design, branding, software, text, features, and all related intellectual property belong to ZigZag Network or its licensors. You may not copy, modify, distribute, or exploit any part of the app without prior written permission.

11. Third-Party Services

Fulik may use third-party services for AI processing, cloud storage, analytics, authentication, payments, and crash reporting. These services have their own terms and privacy policies that may also apply to your use of the app.

12. Availability and Changes

We strive to keep Fulik available and reliable, but:

Features may change, be limited, or be discontinued at any time.
The app may experience downtime, errors, or interruptions.
AI models, features, usage limits, or subscription benefits may be updated over time.

We are not obligated to maintain any specific feature or level of service.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Fulik and ZigZag Network are not liable for any indirect, incidental, consequential, or special damages, including but not limited to plant damage, data loss, lost profits, or decisions made based on AI-generated recommendations.

The app is provided "as is" and "as available."

14. Disclaimer of Warranties

We do not guarantee:

Perfect accuracy of plant identification or health analysis
Uninterrupted or error-free service
Specific plant care outcomes
Compatibility with all devices or operating system versions

You use the app at your own risk and discretion.

15. Termination

You may stop using Fulik at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the app ceases, but provisions that should survive termination (such as liability limitations and intellectual property rights) will remain in effect.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, unless local consumer protection laws in your jurisdiction require otherwise.

17. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted in the app or on our website. Your continued use of the app after changes are posted constitutes your acceptance of the updated Terms, to the extent permitted by applicable law.
